What is Probate?

Probate is the process by which we administer a deceased person's estate, including the appointment of a personal representative, also known as an executor. The probate process is about establishing and acknowledging the validity of a will. However, if a person dies without a will, then we must go through the intestate procedure. Put simply; The probate process is about identifying assets that belonged to a deceased person, the payment and satisfaction of all outstanding debts and bills, and granting the executor of the estate the ability to liquidate and sell assets in order to administer the estate.

Perhaps most importantly, probate is about distributing and re-titling the estate to the proper beneficiaries nominated in the will. Probate is court-driven, based on statutory procedures. Further, probate cases become public record, and it can be time-consuming and expensive.

What are the Options for Probate Law in Scottsdale?

There are basically three options for Scottsdale probate cases. The first option is called a Formal Probate. These kinds of probates are initiated when an estate is being contested. When probate is contested, meaning that people don't like the terms of the will or there is family infighting, it's a long, drawn-out process.

The second type of probate is the most common type of probate, and that is an Informal Probate. This kind of probate is where letters are issued to the executor of the estate, and they go about doing the tasks or the work on behalf of the estate to administer it.
